1. GENERAL. This BJ’s Taps Video Sweepstakes (the “Sweepstakes”) is sponsored by BJ’s Restaurants, Inc. (“Sponsor”). The Sweepstakes begins at 12:00 a.m. PST on December 5, 2014 and ends at 11:59 p.m. PST on January 1, 2015 (the “Sweepstakes Period”). By entering this Sweepstakes, you agree to be bound by these Official Rules and the decisions of Sponsor respecting the Sweepstakes.
2. ELIGIBILITY. To be eligible to enter, you must be a legal resident of AR, AZ, CA, CO, FL, IN, KS, KY, LA, MD, NM, NV, OH, OK, OR, TX, VA or WA; be at least 18 years old; and have Internet access and a Facebook, Instagram or Twitter account, all as of December 5, 2014. Any person who is an employee, contractor, officer, director, agent or other representative of Sponsor, or of any of its affiliates or agencies, and members of such person’s immediate family and persons living in the same household with such person, are not eligible to participate in this Sweepstakes.
3. HOW TO ENTER. To enter this Sweepstakes, during the Sweepstakes Period visit Sponsor’s Facebook page (located athttps://www.facebook.com/BJsRestaurants), Instagram profile (located at http://instagram.com/bjsrestaurants), or Twitter feed (located athttps://twitter.com/bjsrestaurants) (each, “Sponsor’s Page”), and share or repost on your Facebook, Instagram or Twitter account the BJ’s “Taps” video posted on Sponsor’s Page, along with the hashtag “#SweepstakesEntry” or the note “Video shared as entry into BJ’s Taps Video Sweepstakes.” Any posting of the Taps video without this hashtag or note will be disqualified. Limit one (1) entry per person. (Any person sharing or reposting the video multiple times or on more than one of the social media platform options for this Sweepstakes will only be entered once into the Sweepstakes.) Any person sharing or reposting the BJ’s Taps video with a note that Sponsor considers, in its sole discretion, to be inappropriate (including any false, misleading, infringing, defamatory, abusive, threatening, obscene, or other inappropriate message) may be disqualified from the Sweepstakes.
4. SELECTION OF WINNERS; PRIZES. Ten (10) winners will be selected in a random drawing to be conducted on or about January 5, 2015, by or on behalf of Sponsor from among all eligible entries received during the Sweepstakes Period. The winners will be notified by Facebook post, message, or Twitter. Each winner will be awarded a $362 BJ’s gift card. (The value of this gift card is the equivalent of at least one Pizookie per week for a year, although the winner may use the gift card to purchase other allowed items at BJ’s restaurants, as more fully set forth in Section 8 below.) The gift card will be valid for use at any BJ’s restaurant. If Sponsor cannot locate a particular winner within five (5) business days following Sponsor’s first attempted notification, or the winner rejects the prize, the prize will be forfeited and awarded to an alternate winner. Sponsor will conduct an alternative drawing from all remaining eligible entries for an alternative winner of any prize (and will conduct additional drawings, as needed, until the applicable prize is accepted). All prizes will be awarded, but in the event any prizes are unable to be awarded to a winner or winners, gift cards of equal or greater value will be provided to a charity of Sponsor’s election. Limit: One prize per person.
5. ODDS OF WINNING. The odds of winning one of the prizes will depend on the number of eligible entries received during the Sweepstakes Period.
6. OTHER TERMS REGARDING PRIZES. The total ARV of all of the prizes is $3,620. All costs associated with delivering the prizes to the winners are the responsibility of Sponsor. Any other expenses, including all federal, state and local taxes (if any) associated with each prize, will be the responsibility of the winner. Each winner will be notified via Facebook post, message or Twitter and must sign and return an Affidavit of Eligibility, and Liability and Publicity Release (if requested by Sponsor). The prizes are non-transferable, and substitutions may only be made in Sponsor’s sole discretion. Each gift card must be used in compliance with its terms and conditions. Prizes cannot be assigned, transferred, redeemed for cash or substituted except by Sponsor who may, at its sole discretion, substitute any prize with one of comparable value if the advertised prize becomes unavailable for any reason. Each winner shall bear all risk of loss or damage to his or her prize after the prize has been delivered.
7. RELEASE. By accepting a prize, the winner grants Sponsor the right to use the winner’s name, voice, signature, photo and likeness for advertising, publicity, promotional and other purposes in any and all media, now or hereafter devised, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law.
8. OTHER TERMS. The gift cards may not be used for purchases of alcoholic beverages, gratuities, or taxes. The gift cards are for promotional purposes only; they are not transferable or redeemable for cash, and may not be combined with any other BJ’s card, coupon or promotional offer. The gift cards are not substitutable except by Sponsor with one of equal or greater value. The gift cards must be used in compliance with these Official Rules. Lost or stolen gift cards will not be replaced. Any gift cards that have been reproduced, tampered with or obtained other than through legitimate and authorized sources are void. Sponsor’s decision is final in all matters pertaining to this Sweepstakes, including matters occurring because of unintended printer, mechanical, human or other errors. This Sweepstakes is void outside of the states identified above and where prohibited by law. By participating, each entrant releases Sponsor from all costs, claims, damages or injury, whether due to negligence or otherwise, to person(s) or property (including death) due in any manner to participation in this Sweepstakes or use of any gift card. Cash value of each gift card: 0¢. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process or who shares or reposts the BJ’s Taps video with a note that Sponsor considers to be inappropriate. Entrants may not enter the Sweepstakes with multiple Facebook, Instagram and/or Twitter accounts nor may entrants use any other device or artifice to register multiple times or as multiple registrants.
9. LIMITATIONS OF LIABILITY. Sponsor is not responsible for any typographical, clerical or other errors on the Sweepstakes Page or in any Sweepstakes-related materials. Liability for any gift card containing printing or other errors is limited to replacement with another gift card. Sponsor is not required to distribute more gift cards than as stated in these Official Rules. If the Sweepstakes is compromised by circumstances that otherwise interfere with or corrupt the intended operation, security or fairness of the Sweepstakes, Sponsor reserves the right, in its sole discretion to discontinue, suspend or terminate the Sweepstakes and to proceed to distribute the prizes in a manner it determines fair and reasonable.
10. DISPUTES. Any dispute arising from this Sweepstakes or these Official Rules shall be governed by and construed in accordance with the laws of the State of California without giving effect or regard to any principles or doctrines of conflicts of law. Except where prohibited by law, any action arising out of or relating to this Sweepstakes or these Official Rules shall be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a sole arbitrator, all pursuant to the AAA Commercial Arbitration Rules as supplemented by AAA’s Supplementary Procedures for Consumer-Related Disputes (collectively, the “AAA Rules”), which includes payment by Sponsor of many of the fees associated with such arbitration, whether initiated by Sponsor or you. The arbitration shall be held at a location in the state in which you live. There shall be no authority for any claims to be arbitrated (or otherwise disputed) on a class or representative basis; arbitration can decide only Sponsor’s or your individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. ANY RIGHT TO A TRIAL BY JURY IS HEREBY WAIVED. Notwithstanding anything to the contrary in these Official Rules, if the amount in dispute arising out of or relating to this Sweepstakes or these Official Rules is less than the jurisdictional maximum of a small claims court applicable in the state in which you live, you may bring an action in such small claims court for such dispute, which will be in lieu of arbitration or an action in any other court.
11. NOT SPONSORED BY FACEBOOK, INSTAGRAM, OR TWITTER. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, or Twitter.
12. DISCLOSURE OF WINNERS. For the name of the winners of this Sweepstakes, send a self-addressed stamped envelope to BJ’s Taps Video Sweepstakes Winners List, 7755 Center Avenue, Suite 300, Huntington Beach, CA 92647.
